Terms

These terms cover use of this website and the sale of goods by Raghav Natural Stones to trade buyers. They sit behind the quotation, not in place of it — price, quantity, incoterm, lead time and payment are whatever the accepted quotation or proforma invoice says.

The short version The clauses below say it properly. This is the shape of it.
The quotation rulesWhatever the accepted quotation states about price, quantity, incoterm and timing takes precedence over anything on this page.
The drawing is the specProduction follows the drawing you sign. Stone is natural, so shade and grain vary within the approved sample.
Check before it sailsInspection at the works is welcome. Claims work best with photographs taken before the goods leave your port.
Your artwork stays yoursDrawings and designs you send remain yours. Our drawings, photographs and site content remain ours.
Part 1

Using this website

  1. 1.1

This website is published by Raghav Natural Stones, Krishnagiri, Tamil Nadu, India. By using it you accept these terms.

  2. 1.2

Product descriptions, stone names, finishes, sizes and photographs are indicative. Stone is a natural material and no screen reproduces it exactly; nothing on this site is an offer capable of acceptance.

  3. 1.3

Where a page states a number of countries, stones or production stages, it describes our business generally and is not a warranty attaching to any particular order.

  4. 1.4

You may not copy, scrape or republish the content of this site for commercial use without our written permission.

Part 2

Quotations and orders

  1. 2.1

Enquiries are answered with a written quotation stating the stone, specification, quantity, unit rates, incoterm, packing and the validity period of the quotation.

  2. 2.2

A quotation is an invitation to order and is valid for the period stated on it. Rates may be revised after that period, in particular where stone, freight or currency has moved.

  3. 2.3

An order is formed when we confirm it in writing, or issue a proforma invoice which you accept, whichever is earlier.

  4. 2.4

Once the production drawing is signed and cutting has begun, an order may only be changed or cancelled by agreement, and you remain responsible for work already carried out and material already committed to your order.

Part 3

Price and payment

  1. 3.1

Prices are quoted in the currency and on the incoterm stated on the quotation, and are interpreted according to Incoterms 2020.

  2. 3.2

Payment terms are those stated on the proforma invoice. Production is scheduled against cleared funds unless we have agreed otherwise in writing.

  3. 3.3

Duties, port charges, customs clearance and taxes payable in the destination country are yours, unless the agreed incoterm places them with us.

  4. 3.4

Bank charges are borne by the party whose bank levies them, unless the proforma invoice states otherwise.

Part 4

Production, samples and tolerances

  1. 4.1

Nothing is cut until you have approved a production drawing, and where shade matters, a physical sample. The approved drawing is the specification for that order and for repeat orders placed against it.

  2. 4.2

Stone is a natural material. Variation in shade, grain, veining and mineral marking is inherent, and samples indicate the range rather than guarantee an exact match. Where consistency across a set is required, tell us at enquiry stage so the batch can be held to one block.

  3. 4.3

Dimensional and thickness tolerances follow ordinary trade practice for the product and finish concerned, or the tolerance stated on the approved drawing where one is stated.

  4. 4.4

Lead time runs from the later of order confirmation, drawing approval and receipt of any advance payment.

Part 5

Packing, delivery and risk

  1. 5.1

Goods are packed in fumigated wooden crates or on pallets, edge-protected and strapped for sea freight. Special or private-label packing is available where agreed at order stage.

  2. 5.2

Delivery dates are estimates given in good faith. We are not liable for delay caused by vessel schedules, port congestion, customs or other matters outside our control.

  3. 5.3

Risk and title pass as the agreed incoterm provides; where the incoterm is silent, title passes on receipt of payment in full.

  4. 5.4

Loading photographs and container details are issued with the shipping documents.

Part 6

Inspection and claims

  1. 6.1

You, your agent or a third-party inspector may inspect the goods at the works before loading. Where inspection is carried out and the goods are passed, claims on matters that inspection covered are not accepted later.

  2. 6.2

Claims for shortage, breakage or non-conformity must be notified in writing with photographs within the period stated on the proforma invoice, and before the goods are worked, polished, engraved or installed.

  3. 6.3

Where a claim is accepted, our liability is limited, at our option, to replacing the affected pieces on the next shipment or crediting their invoice value.

  4. 6.4

Breakage in transit is a matter for the carrier or cargo insurer under the agreed incoterm, and we will provide the documentation needed to support that claim.

Part 7

Drawings and intellectual property

  1. 7.1

Drawings, artwork and designs you send remain your property. We use them only to produce your order and do not offer them to another buyer.

  2. 7.2

Drawings, templates and production sheets we prepare remain ours, and are retained so that a repeat order can be produced to the same specification.

  3. 7.3

We may photograph completed work for our records and portfolio. Tell us at order stage if a piece is confidential and it will be excluded.

  4. 7.4

You confirm that artwork, lettering and images you send do not infringe anyone else's rights.

Part 8

Liability, force majeure and law

  1. 8.1

Our liability in connection with an order is limited to the invoice value of the goods concerned. We are not liable for loss of profit, loss of contract, site delay costs or other indirect loss.

  2. 8.2

Neither party is liable for failure or delay caused by events beyond reasonable control, including quarry closure, plant breakdown, strike, natural event, epidemic, war, sanctions, port closure or government action.

  3. 8.3

Nothing in these terms excludes liability that cannot be excluded under applicable law.

  4. 8.4

These terms and any order are governed by the laws of India, and the courts at Krishnagiri, Tamil Nadu have jurisdiction, unless the parties agree arbitration in writing.

  5. 8.5

We may update these terms; the version in force is the one published when your order is confirmed.
